Assume cops serve a search warrant. Will they break into a 600+ pound safe in order to search for apparent steroid possession? Assume this is a simple controlled delivery, and not an intent to sell search.

If the police are looking for evidence do you really think they are going to stare at a huge safe and shrugg their shoulders saying, "I guess nothing's in that safe!" ? NO, they won't do that. They will search everything. If you refuse to open the safe by giving them an excuse, then that will only pique their interest.Quote:

If they have probable cause to have a search warrant. All dwellings on the property like the shed in the back or garage up to and including all rooms including the attic are included. They have belief evidence may be in a safe they will have an open space on the warrant and write it in they took the safe with a brief description. They will take the safe back and cut it open. They can and will leave no stone unturned. If they want they can drill out your driveway if they think you are hiding something under the house.

C130 posts are somewhat misleading...not that I believe he did it on purpose. If cops come and have a warrant for guns and you have gear, you are **** out of luck. Things found during a legal search and seizure can be used against you. The only way out of this is if they acted illegally. Like they were looking for a car in your house and looked in a drawer. A car could not reasonably be in a drawer so they had no right to be in it. This defense hardly ever works. I would clean house if you are this worried you may have heat. You should be running far enough under radar to leave your gear in a drawer. If not, clean out and find a cool place to do your thing. Hope it helps...JC

Not sure where you got your legal training bro but if the warrant is valid and they find anything else, as long as it is in a location that could have held what the warrant is for, then it is fair game. For instance if they have a warrrant that you stole a statue, and they come in your house and find anything where a statue could fit, it is admissable. However if they go through your drawers looking for a statue, they are SOL if they find anything...unless the warant includes proceeds from criminal activity.Quote:

If the cops show up and they ahve a search warrent then they will search everything.....you don't open it they will take it and slice it open or get a locksmith to pick it.
Do NOT keep more than what you need for week in your home. Find another place to keep things you don't want found. You don't want to jepordize lossing your home or car over something found under a warrant.

There are a ton of safes out there that require more than a simple lock smith. Many of the better safes would require a specialist. Just wondering if they would go through the trouble for a personal stash. Especially considering there is a chance that it may not even be in there.
On a side note....if cops trash your house and find nothing, are they then liable for damages?
No, as long as they used reasonable care searching it. If you refuse to open a locked area or safe, and they have to break it to gain access, your loss, regardless of what they find.Quote:

Yeah their not liable for jack. I know I had the cops search my car once for stolen property and they tore it apart. They took all of the speakers out and left them in my driveway. They said that they didn't have to put anything back despite the fact that I had nothing in there and didn't do anything wrong. I hear it is the same way when customs searches your car at the border. They just leave you standing there holding your car parts. kinda sucks.
