What should I do to this EX-employee?
I recently had to fire an employee of mine for good reason and it didn't end well. I owe him a weeks pay but I am thinking twice about giving it to him. Heres what happened.... I own a construction company and for the month of July things were going to be tight so I cut some hours to some guys. No one complained because we've been going strong for the past 3 years....no one has taken a break. August was going to boom again so it was a nice break. Collecting got tough on my end so I told my guys instead of paying you on Thursday this week, I will pay you on Monday. This one particular guy had the Friday off and decided to get hammered and call me about 10 times to make sure I wasn't joking. On the Friday morning he called me about 10 times, still pissed drunk for the same reason. Friday late afternoon he called me and could barly talk, but he could sure yell! He told me to watch out because he is going to come with his boys and kill me and my family, whip out my name are the exact words to follow. I told him to look for a new job and hung up, but he kept calling until I told him I will call the police if he calls again. Then he phoned every employee of mine and talked crap about all of them to each other causing them to argue amongst themselves. He hasn't called me since, he must have sobberd up.
My employees are all very close and they have been loyal to me for years. They work very hard for me and in return I am very good to them. They have all been with me for 5 years plus. I give them generous bonus's, everything from gas, trucks, phones etc... is paid for. I give them loans to help them buy there houses and cars etc.... They are paid very well compaired to other companies and I have never ever missed a pay.
I owe this punk $1,500.00, should I pay him or tell him to take me to court? In all honesty, I don't want to pay him. He threatened me and my family.
What would you guys do?

well if he is on the books, and can prove his hours, then your gonna have to end up paying him.
Is it worth your time and hassle to not pay him and go through the courts for months or however long it will take, or Just pay him, and get rid of him and make sure if anyone calls for a reference you speak your mind
depends on the labor laws in your area, but it might be better to just pay him and put it all in the past.

I'll bring him his cheque and termination papers then crack a 2x6 over his head! This F***** threatened my family....my kids!!!!

Why bring it to him, make his sorry ass come crawl for it to you
he probably doesn't remember threatening you, but you can remind him with the 2 X 6....lolol
or tell him you mailed the check.......opppss it got lost in the mail....

its his money, not yours i know that sucks. if he is in construction now, he is probally going to catch heck trying to find a job, if yall housing economy is anything like ours down here, so him being hungry, sober and unemployed will hurt worse than a butt whooping.

It'll be less expensive just to pay the $1500 and be done with him. Taking things to court will cost lots more and will take up lots more of your time.
I'm not suggesting anything, mind you, but wouldn't it be too bad for him if someone was to beat him up and take that $1500 once he got it . . .

Have someone else deliver the check to him so you two don't have to meet. Give that person an extra couple bucks to let him know how you feel. Bonus for broken bones and pictures.

when I was way younger I did that same thing minus the family threats. I went the next day and apologized in person and I lost my job, it was a good job too, lesson learned.

Tell the chap you want to speak to him in person. Have the cheque, explain your sorry its come to this but the calls were unacceptable. Give him the check and say thanks for his time working for you.
This will make remind the chap of you good manner and wish he didnt have a big gob. If you get bitchy with him he will most likely cause s%it or at least mouth off to other people.
You need to play this the clever way, forget what the Muppet said on the phone and use your noddle. This is what id do. Oh and if he gets violence or gobby when in person, which i very much doubt then either fight him or at least have a friend in the background ready if he pounces.

No need for insults....you obvioulsy didn't read the whole situation and you obviously don't have kids! I'm the guy the Union phones to take there best workers. I always put my workers first and there all well respected in the field because they work for me and my company!!! $1500.00 a week pay for a worker with 3-4 years experience in todays market is alot of money....I share my success's with my guys. If you think I'm a dick....your obviously the dullest knife in the drawer. And if someone came to my home, where my family is to collect anything without an invite, they wouldn't make it past the gate!
To everyone else, thanks for the advice. I decided to give him a partial payment and the Union will be giving him an audit to make sure he's been honest with reports. That should take a couple months. I will pay him, I just want him to suffer alittle and get stressed the same way I was. And I will ruin his reputation with the Union. I'm taking this personal. You never, ever threaten a mans family and kids. Especially if he's the hand that feeds you!
I do alot of large commercial contracts and high rise. In todays tough market work is scarce. I am extremely lucky to have alot of work. Thats is thanks to my good repuation and loyal employees. I just had a tough month. If I was todo or say that to any of my customers and clients I would be charged, loose my contract and kiss my money good buy. I totally understand some peoples advice that I owe him so pay him....your right and I will. Now instead of thinking like the worker who is spoiled, overpayed and riding high on my cloud, think like a boss and more importantly, like a father!

m8 you should have paid the guy . ffs if you work for it all week you deserve your wages at the end of the week not monday . he should not be threatening your family . but i think of you were both wrong . give him a written warning give the lad his job back . we all made dicks out of ourselves at some point .

Yes you should pay him. Besides court he could file a complaint with the state labor board. Just like you probably dont care the excuse you were given by the people you were collecting from, he is in the same boat. You gave him an excuse not to pay him. What if he was depending on that cash this weekend for a bill or some other reason. Do you think his landlord would care that he didn't get paid?
And yes he shouldn't have threatened your family.

You probably are a good guy. And as a boss you can probably be a dick.
You need to pay this man his money. He is probably going through some serious shit you have no idea about. And if you take care of you people so much find out what is up with his attitude.
No excuses on his part for saying what he said.
1500 is alot of money for a week . And he may depend on that money on friday.
You need to pay the man. His work has made you money . You OWE him his.
Would I give his job back after saying what he said. Hell no. And I would probably F@ck him up for it to.

I did not read this thread, just your post. Take the high road always and you win in life. If you owe this guy pay him and let him move on. Don't bad mouth him openly, try to black ball him or anything. If you ever get a call for a reference just say I rarely give references unless I ahve a great connection with an individual. Move on.

Pay him to get this all taken care of. THEN call up any connections/friends in other local construction companies and give them the low down on this guy to make it a lot harder for him to find another job.

Pay him then have him escorted from your worksite by some type of security. That will send a message not to fvck with you.

its understandable that you had to delay giving out paychecks. it happens, as long as its not a regular thing it shouldn't be an issue. in terms of the guy, leave it up to him to get the money, don't withhold it from him, but don't go out of your way to get it to him!! he probably gets paid cash so you could prob screw him over if you wanted to but it might be best to just cut the cord on this guy and move on

My advice is: ' The wise do not argue with those who are un-armed'.
Remaining silent is golden. Put the check in the mail and don't communicate further. It's probably wise to have a meeting with your crew and let them know this type of behavior will cost them their jobs...

You owe him the money so you have to pay, in the even he is fired in Canada we have to mail out the money and ROE to him if he does not pick it up within 5 buiness days (IIRC). I hope you already filed a police report, might want to think about a restraining order to protect you family too.
Make sure that your report and reason for firing him is well documented so he can not recieve Employment Insurance now that he is out of a job.Last edited by cfiler; 08-14-2009 at 01:25 AM.
