    D.u.i.

    I got a D.U.I. Two nights ago! I'm really stressing abt it. I have court on Friday. I wasn't drunk an had only drank two beers, I felt like I was being targeted by local cops because I'm a union construction worker that travels. I'm in a Littel small town in Ohio right now working in a refinery and like any town win we all get here they try to bleed us dry in any way they can from all angels. The cop pulled me an my friends over pulling out of a bar n grill, we had only been off work no more thin an hour an I had wint home to shower and met my friends at a bar we all new so we could all go to dinner. The cop pulled me over as we was pulling out of the Bar, really how drunk could I have been in that time fram! figured it didn't matter if I was drunk or not at this point and nothing I said I could have helped me so I told the officer I'm not drunk! Ether you arrest me for DUI or let me go! I'm not taking any of your test and I'm not letting you do anything to incriminate me So I was charged with a crime. Have any of you ever been in the situation? What would you have done?

    Man that's a bummer! The law now considers a refused breathalyzer as guilty. And you will always get a DUI. However, by not taking the test is your only way to possibly beat it in court with a lawyer. If you decide to try to beat it, best go way out of that small town to get your lawyer. And I'm sure you realize that those cops are gonna probably have you on their radar for as long as you are there. Good luck bro.

    I have a vary good attorney and I thank if I make a case that I felt like the cops are targeting pipfitters and I have Union stickers on the back of my car with my out of town plates. The cop followed us from the bar and any detectable amount of alcohol the cop was taking me to jail regardless so why incriminate my self any more and play along to there cat and mouse game. The cops control traffic win we get off work so they know how long it takes to get out of here, I wasn't dirty or in my work close so obviously I wi obviously my home to shower. I can show on my bank stament win I got money out at the bar, if you factor all that in with my arrest time it's impossible that I was drunk. The office said they had to hold me for 8 hours befor they could or me out to assure I'm sober win they turn me loose. The cop in the jail said he couldn't smell a drop on me an said I thank your sober so he cut me loose with in the first hour of being there. Hopeful that all factors togather.

    In my state if you refuse the test they cannot prosecute you for dui but you automatically loose your drivers license for 12 months.
    If you knew you weren't legally drunk why wouldn't you just take the breathalyzer test and be on your way after you passed it?

    The thing is I don't thank I would have past. .08 is the limit so the way I seen it I was ****ed any way you go abt it so why give those basterds any thing.

    Not trying to be a dick but if you were over .08 you were drunk.
    I have a couple of friends that are in law enforcement and they have told me that if you have only had a couple of drinks like you had you are better off to take the test. Even if you fail the breathalyzer by the time involved to get you to a hospital or clinice to take a blood sample you probably would pass the blood test.

    Like ppl have said, u will loose your license for x amount of months but if your guy is even half way good he should be able to get the dui dropped.

    I have a family lawyer that takes care of everyone in the family. His advice was, if your drunk and driving your a idiot but the best thing to do is put your hands out the window with your car off. Don't say a damn thing and let them slap the cuffs of u.

    Of course different countries will have different situations, but I've squezzed myself off traffic violations just by being humble and showing humility.

    Definitely true. But a speeding tickets alot different then dui

    I agree. I have been humble an respectful to cops and been vary upfront abt what I did an admitting I new it was wrong, that's really my personality any way to be completely honest but I don't thank any thing short of a good attorney an lack of evadince will get you out of a dui. I just talked to my attorney for the first time an he said under the circumstances he can most likely have this thrown out.

    You should have requested a blood test. Never do the field sobriety or breathalyzer. Refusing to do any test is the same as failing. You are now guilty so you had better later up and be willing to pay.

    Always be polite but insistent. At least with the blood test there is little chance of error and most of the time it's several hours before they can get it done because it has to be done at a qualified medical facility such as an ER, not at a police station.

    My first wife actually got her DUI thrown out because the cop basically scared her into doing a field sobriety test and discribing the procedure. Since he was not an MD and did not have proper medical training he was not qualified legally to do so and it got dropped 100%.

    In a lot of states such as mine (Washington) .08 means nothing. They can just as easily get you for impaired driving even if you blow a .02. The fines and punishment are pretty much identical. Another reason to NOT do a field sobriety test.
