    Getting Busted On Workmans Comp

    a friend of mine went out of on workmans comp with a legitimate injury (bulging discs in his neck). however he is a total gym fanatic with a very high pain threshold, and just can't stop going to the gym. he is afraid some private detective will take pictures of him training, and the pics might be taken out of context while he is seeing "Dr. Summeroff". does anyone have any practical advice or experience with the tactics these private detectives use, and how to avoid them?

    tell him to work out at home till he canfind some where low key def dont go to his gym where his name is reg. in the cpu...tell him to do 2 week membership under fake names where his hat low at the gym

    Wait wait.. he is on work comp because he can't work but he can still lift?? seems like fraud to me. what am I missing here?

    If he is able to lift he should be able to work at least some?

    he is an experienced and dedicated athlete that is very good at working around injuries. there are many football players that play with broken bones and injuries that would clearly disqualify them from any other physical job in a workmans comp situation. the bulging discs occurred during a work accident, have been confrimed by MRI, his doctor has decided not to return him to work until the discs are repaired, and he regularly goes to physical therapy to try and get better. he is just one of those guys that always pushes harder than he probably should.

    Does he have A lawsuit pending over this incedent

    If so I would tell him to be very careful and watch to his back.

    If not I probaly wouldn't stress to much it cost alot to hire A P.I. and for just A regular woker's comp isue I can't see them doing that unless any of his budies that he was working with know he's still working out.

    Work out a home. Insurance carriers are bad people. Just looking for an excuese to deny a claim.

    If he owns his own home, i'd use cash n buy some equipment hide it down in the basement.. better safe than sorry. Most importantly tho, keep his mouth shut.

    no doubt, and you dont wanna get ****ed over by workers comp either, not to many people will be quick to hire you

    the evidence was so clear, the case has already been resolved, and he is getting his regular paycheck while he undergoes physical therapy. this company has occasionally been known to hire PIs, but its rare.

    I had double hernia surgery....comp....
    I still went to the gym.....Do light reps.....i still couldnt go to work cuz i couldnt lift with my legs......

    They won't send P.I's after him. If the MRI confirmed it and his workplace has seen the MRI then its no bullshit. P.I's are hired for cases where doctors see nothing wrong with the patient physically but he person insists on staying out of work. An MRI is about as a solid rock piece of evidence as you can get about not faking an injury.

    Exactly! Downright fraud IMO. If you are hurt bad enough to be on workmans comp, you should'nt be doing anything but sitting at home recovering.

    If he is so good at working around injuries, why can't he work around his injury at work?

    The poster said.. summer off - that tells the story as it is.. it is fraud..

    Yes the man is in deed hurt, but not hurt enough to really warrant being off of life...

    How much did he have to pay the doctor to give him the right paper work after the MRI?! lol

    It doesn't mattter if the guy technically could go into work and be able to take the pain, once a doctor has not cleared you to return to work your employer will NOT let you return because if you injure something else or worsen the existing condition then you can sue your employer. So, because the doctor will not clear him, even though he can still train, he is somewhat screwed. The thing with PI's...if your work does hire an insurance PI then it would be very difficult to not get caught if he leaves the house. They will sit for hours waiting to follow him.

    IMO, if he has such a high pain threshold and he is able to lift than his ass should be at work............

    I was off on workers comp because of a fractured knee at work. I was able to go to the gym, and work out upper body only. I had a signed note from my doctor listing it, incase of any issue with workers comp.

    I needed it. Someone who I worked with saw me at the gym. She called in to my work's insurance company, and they had a PI come by to find out why I was at the gym, if I couldn't work. I showed the PI the note, and went on my marry way. Never had any problem after that.

    It's easy to get caught. All it takes is one person to notice, or one little f*ck-up.
