Would like some opinions on this
I was driving on a two lane road (35 mph speed limit) in the right lane. An older woman was in the left lane Parallel to my car. There were cars in front of and behind my car. The woman next to me swerved about 4 feet into my lane. My reaction was to lay on the horn and avoid contact with her vehicle by moving to the right. My wheels and part of my bumber contacted the curb.
I motioned for the woman to pull over, she refused. My reaction was to pull in front and signal her over, again she refused. I wrote down her plate along with a description of her vehicle. I pulled off into a parking lot and contacted the police. Police took my info. and I headed home.
The police Identified the woman (87 years old) and I contacted my insurance. Her insurance company asked me to get an estimate, I did. ($800) I waited a few weeks and got a denial letter. WTF!
My insurance adjuster tells me that the woman denied the event and her insurance company will not reimburse me for the damages. My options are:
1) Drop it and chalk it up as getting f'd in the A
2) Go to litigation, in which case I might recover 50% of the damages
What do you guys make of this? It just seems like I'm getting screwed here and theres got to be a better option. The damages are 800$, is it worth pursuing![]()
