Man charged with battery for farting near cop

SOUTH CHARLESTON, W.Va. - A man has been charged with battery on a police officer for allegedly passing gas and fanning it toward a patrolman.

Jose A. Cruz, 34, of Clarksburg, W. Va., was pulled over early Tuesday for driving without headlights, police said. According to the criminal complaint, Cruz smelled of alcohol, had slurred speech and failed three field sobriety tests before he was handcuffed and taken to a police station for a breathalyzer test.

As Patrolman T.E. Parsons prepared the machine, Cruz scooted his chair toward Parsons, lifted his leg and "passed gas loudly," the complaint said.

Cruz, according to complaint, then fanned the gas toward the officer.

"The gas was very odorous and created contact of an insulting or provoking nature with Patrolman Parsons," the complaint alleged.

He was also charged with driving under the influence, driving without headlights and two counts of obstruction.

'I couldn't hold it no more'
Cruz acknowledged passing gas, but said he didn't move his chair toward the officer nor aim gas at the patrolman. He said he had an upset stomach at the time, but police denied his request to go to the bathroom when he first arrived at the station.

"I couldn't hold it no more," he said.

He also denied being drunk and uncooperative as the police complaint alleged. He added he was upset at being prepared for a breathalyzer test while having an asthma attack. The police statement said he later resisted being secured for a trip to a hospital that he requested for asthma treatment.

Cruz said the officers thought the gas incident was funny when it happened and laughed about it with him.

"This is ridiculous," he said. "I could be facing time."

Getting angry is one thing. Using your power as a police officer to charge the person with battery on a police officer for farting is just so ridiculously abusive of his power I think he and his supervisor should be fired.

Do you feel 'provoked' like you feel that someone is starting a fight with you if they fart near you? Do you feel provoked if you have a gun and all your friends have guns and the person who farts is in handcuffs? LMAO

I have yet to meet one human being on the face of this planet who does not put up with unnecessary bullshit. Cops don't deserve special treatment or any more respect than any stranger on the street- unless they EARN it. Farts keep cops human, just like the rest of us.

If someone was in a doctors office and the patient lifted up his leg and farted, would the doctor call the cops because he felt 'provoked'? Would he call the cops to file criminal charges against the person?

I farted next to two cops, one was telling my best friend how he was a loser bla bla, and the other one came up to me and said just do it again and see what happens, he was real pissed, well I grunted and grunted but I didnt fart. so I says to em sorry but I cant fart right now, I have no more. he was so pissed, this was all in front of a movie theater and there was a crowd of people laughing there asses off, needles to say no one was arrested and this was over 20 years ago. they had it in for my friend and he would be harrased everywhere he went. he was just a troubled teenager not a real criminal at all. back then it was a small town with to many cops and no crime going on, so they would pick on some kids to mess with, like the ones that came from broken homes. I know there are alot of great man and woman that are cops, but I met alot of them that should only be security at a mall.
