    DV arrest update:

    From previous post for those of you who remember:

    Got the paper work in the mail, suppose to go to see the magistrate on Thursday.

    Really upset about this, but just going to play it smart, be calm, not let my pride get in the way, and lie my ****ing ass off.

    Not 1 tiny bit ashamed of what I did, told my own mother the real story.

    The magistrate or prosecutor will not even get a story, attorney handles it from that point on.

    I'm still in awe at these laws. It's legal for my (ex) gf to come home drunk, start breaking everything in my house. But if I put her out on her ass, I could go to jail?

    What's the appropriate way to prevent thousands of dollars and shit from being broken?

    Officers ruff up about anyone they arrest when they are belligerently drunk, bouncers throw drunks out of bars all night.

    next time you call the cops on her. She told them u slapped her first. And you did. She in facts lives at your house so you cant just put her out on the curb. Next time call the cops. They will make her leave.

    They actually can't remove her either.

    It's a civil matter if she breaks anything of mine, because she lived here.

    That's why I threw her out, cause last time I did call the cops, and their hands were tied.

    I was an idiot, wrote it off as a drunken rage and ended up in this mess.

    So you basically have to watch her break everything you own, then file an 7-day notice Monday. After the 7-day expires, you both get a summons to move forward with eviction proceedings. Takes about 30 days from start to finish.

    After that, I can go after her in civil court for the cost of damaged items.

    they cant evict her. but they cane make her leave for the night so things come down and there aren't any further issues that night.

    Trust me i had cops do it to me. Yours may have been lazy

    If she picked me up, and threw me out for breaking her stuff, I could have her arrested.

    Short story to give some back ground:

    2 year ago, i was with this same girl. We broke up, she moved out.

    6-months later, I was bowling with my girl friend (new one) and my ex (this crazy girl) was dating another girl.

    My crazy-x's girl friend was at the bowling alley, and text "crazy" that I was there with a girl.

    When I came home, she was in my house.

    I called the cops (Keep in mind, she moved out over 6 months ago) and had an officer over.

    She told them, "Some of this stuff is mine!".

    I did not have the door locked, no forced entry.

    Because of that, it was a civil matter, the cops would not remove her, and they would not allow me too either.

    My girlfriend at the time, had a brother in-law who was a officer, we talked to him about it and on matters like these, they can't do anything until unless someone is assaulted.

    I will deal with it, I just don't believe in hiding behind your gender or the way the law is written.

    I think of some little white guy is all up in a colored guys face, spewing racial slurs, I also think it's appropriate to punch him in the face too.

    So basically she came onto your property and made herself at home and the police officers did not do anything? If you would have came onto her property and did the same your ass would be in jail.

She called the cops out of hate and has him arrested. He was at his own home. With another girl. They still took him and locked him up! Woman´s word over an man´s word.

    I gotta agree with Moose on this one. Hit a chick...go to jail. It's that simple. I've actually experienced the above situation. A white guy dropped the n-bomb on me at a club here in Vegas. I dropped him. One punch, lights out. Guess who got arrested? ME!!! And by a black cop. And was sentenced by a black judge. Free speech isn't designed for popular speech. Assault is assault no matter how you try to justify it.

    I think there is a saying referring to freedom of speach that goes "The right to swing your fist stops at another man's nose".

    This has applied to KKK rallies in such in the past.

    I clearly understand the laws, I just don't agree with them.

    Assault/fighting/public disturbance actually states you cannot even fight back if someone attacks you, unless there is no opportunity to flee.

    Even if someone attacks you out side a restaurant, according to the law, you can both be arrested unless you just try to run away.

    An officer is probably not going to arrest you, but the laws are written so they could if they wanted.

    No where in the report does it state anything about me slapping her either. Only using physical force to remove her from my house.

    I apologize, some times I get carried away and spew on.

    My basic idea of that was, that the law does not care if it's the male or female who does the assault or physical removal. The people who enforce the law might look at it different though.

    I've called the cops on her for attacking me, I just did not press charges or have her arrested, Just wanted them to get her out.

    Hey I agree with dropping the guy bro, I just don't agree with how the laws work.

    There should be consequences to verbal abuse, slander and taunts. If you want to complain about the government, a policy, a tax, that's freedom of speech. The situation you explain is inciting violence if you ask me.

    The worse thing that can happen to me is some fine and probation, I'm really thinking of just fighting strait through to a trial.

    The girl has a mental history and documented drinking problems. My record is squeaky clean and I have a very good reputation in the community. A jury of peers may feel it's appropriate for me to remove her when she comes home drunk breaking my things.
