    Should The Police Have The Absolute Right To Pilfer Through Your Cell Phone Whenever

    So say you are pulled over for a burned out tail light and the cops run your license and you have an outstanding charge of failure to pay a minor previous ticket. Should the cops then be allowed to go through your smartphone and look at everything and everyone in there including reading all your texts and other private info all under the guise that you could be doing something illegal so they want to see if they can get you on something else? This is now where we are at in America where none of us have any rights whatsoever and we are all guilty till proven innocent in a court of law! Ever since 9-1-1 we have constantly and consistently lost more and more of our rights here in the USA. We are now constantly recorded on all our phones by the government and we are now almost always videoed everywhere we go to the point we are now with less rights than the Russians. Ok maybe not that bad but you get the idea and I don't know where it all will end. What do you all think about the cops being able to go through your phones without a search warrant whenever you are stopped and arrested no matter how minor the offense?

    All I can say is I sure hope they look at the pics I have on my phone.... But I definitely will keep the texts deleted....

    No. They have the right to retain it while you're in custody but they do not have the express right to search it. That would require consent or a warrant.

    hat is why I have a password on my cell phone and I keep it locked. They don't have a right to look at anything, including my car if I am being arrested for a ticket. They can tow it and "have it inventoried" but this is unlikely. They can kiss my ass. The most dangerous person is one that knows their rights due to the fact that most police don't.

    I also have two video and audio monitors in my car, just like most people in Russia, just to protect myself. I was in an accident and that recording proved I was in the right unlike what the police report was trying to say, due to a police car hitting my car.

    Always pass word protect your phone and know your rights. Never consent to any type of search whether you have something to hide or not

    Kel is correct (of course). The search of your phones contents requires a search warrant.

    Kel I only wish you were right. well you are I think right now but from what I saw on the evening news, if you are arrested then that gives them the right to look through it as it isn't protected. They liken it to arresting you and going through your wallet trying to say it's like an extension of your wallet therefore they have the right to look at it. President Obama is supporting this new twist on the law and our rights. This sucks and so does he if he really supports it. Like I say since 911 we have and continue to have lost more of our rights and privacy. Welcome to the United Police Sates Of America

    The Supreme Court is expected to rule on this exact situation (phone being searched incident to arrest) by June. Currently lower courts are split in their decision. Some states require a warrant to search the phones contents after it has been seized based on the fact that their is no exclusionary rule that would be in effect if the phone was already seized, meaning that it was not a threat to life nor was there a fear of evidence preservation.

    Other states have ruled that their is no more right to privacy of your phone that there is the contents on your person being searched incident to arrest. IMO the SC will rule in favor of the right to privacy in the case of cell phones and a number of convictions will be overturned.

    Well what you need to understand before rage is that...

    for 2400 USD

    You can own a device that allows you to pull ALL information from a person's cell if they are within 100 ft of you. Police in Michigan were caught using these. SO I bought one and I snoop onto them as they snoop onto me. Also snoop onto my temporary girlfriend's phones....

    I would normally say no but in this case fvck No.

    How long have I been saying it's becoming a police state/country not much different than 1940s Germany.

    Ive had this discussion a few times with a co worker and he use to think it was fine to let the police in your/his house anytime without a search warrant because if you dont have anything to hide nothing will happen. I tell him to try to tell that to the people who lived ing Germany during 1940. Of course he says it's not the same there and that would never happen. His brother talked some sense into him and a few more recent videos of catching police doing bad thing convinced him maybe it's not such a good idea.

    Things will get worse before they get better and also as I have said it will take a revolution or a world wide natural disaster.

    The problem that most people fail to realize is that just because the police are "not allowed" to take certain actions does not by any means prevent them from doing them.
    I know this first hand from several experiences that they do what they want when they want.
    The majority of the population cannot afford the time off work to go to extensive trial proceedings or the cost of experienced council to fight and overturn the convictions.
    Even then...in one of my cases which I did fight the illegal search seizure. They were able to find a case which set precedence now that allows a police officer to search your vehicle without consent if he/she feels they are in imminent danger...AKA they do not need your permission any longer and it is your word against theirs in the court of law if their fears were founded or not.
    So the short of it is have a better plan than just stating your so called "rights" and what they are allowed to do or not do...because that generally will end up in you getting your ass beat for what they will call "resisting arrest" or "threatening to do bodily harm" or "failure to comply with the direction of a police officer" the list goes on & on... summary-gangsters with a badge...

    Yeah I find it absolutely incredible what the police will call resisting arrest. I have seen things as small as arguing with a police officer and he arrest someone for resisting arrest. So the term resisting arrest is a blanket term the cops use for arresting anyone anytime with absolute impunity. But not all cops are bad cops, but the problem is that a lot of bad people with ulterior motives become cops and make the good cops look bad. Not to worry though Lunk I'd still date a cop..

    Agreed on the " Not all cops are not bad cops." I have run across some legitimate cops that are actually interested only in upholding the law within the rules.
    I think its not completely their fault when they go bad because they are surrounded by ass holes 24/7 who don't have rules and they just little by little by little bend the rules in order to serve justice and eventually it just becomes easier/ more profitable to just ignore the rules in the pursuit of "getting the bad guy."
    The problem is their judgment becomes clouded to who is actually a "bad" guy or just someone who forgot to turn on their blinker..

    When dealing with nothing but scum all day, it's easy to become jaded. You forget that 90% of the population is good when you only see the other 10%. Just like those who have dealt with the 10% of police that are bad when the other 90% are just kinda assholes

    Be polite but dont answer questions. The only reason police ask you questions are trick you into self incrimination. Dont answer where your going on coming from, ever. Never consent to search. The only questions i answer are when im asked if i was drinking and if i know why they pulled me over, always answer no. Even admitting to one beer can give some asshole cop the probable cause hes looking for.
