    Need your advise on unemployment legal matters

    Hey friends....

    I'm stress and in deep thoughts. I need your advise on some legal matters.......Few weeks ago, I lost my job overbeing micromanaged by the supervisor......So, I went on and file for an unemployment benefit. I was denied this benefit because my employer (the HR department) report that I was discharge for some misconduct shit which made me ineligible for unemployment insurance benefit.....I filed an appeal and challenge their allegation of misconduct..........The Judge dismissed their allegation and rendered a decision in my favor......My employer (HR) re-appeal that decision to higher administrative court.....Now the question is will the decision in favor be reverse if they make a good case....will I be force to pay back some of check I collected....please advise????

    You will win again.
    Did you get written warnings or were you just released?
    the courts side with workers unless you stole something or fired for conduct where others were put at danger.
    State laws are different but here in Rhode Island you must recieve 3 written warnings or the employee automaticly gets unemployement benefits if release before getting them warnings.

    Unless they have documented proof of this misconduct, I dont see any way a court sides with big business over an individual. So Unless you were written up for a specific incident, had been put on a PIP, or some other kind of documented disciplinary action, they will lose.

    I agree with the above comments but to be safe I believe you can ask for in advance anything they may be submitting as evidence so you have time to prepare to disprove them.

    Same exact shit happened at my last turd bag ass job. They didn't contest my appeal though.

    Last time I was on unemployment my employer extended it to over 1yr and paid for my IT schooling up to $10,000

    I still do. I just went back as network admin instead of factory worker making about $24k more and spend most of my time online here. LoL

    From a guy who has employed an BUNCH of people... you will win. These guys are just being dicks and in the end (unless there is something you are not telling us) all will be peachy.

    Just dont be one of those guys that wake up at noon and milk the hell out of the Govt

    Thank u everyone for your advise. Yes, I had 2 warnings prior to dismissal. Each of these warning were baseless. I refuted both of them and won the first case by defult of them not showing up at the hearing. Now I'm awaiting the results of the 2nd hearing that took place 3days ago. This time my employer was respresented by small consultant firm. They stick to their original story and so I was. The decision is pending till next week in mail. If I won that would be great but if not I would be in an unnecessary debt of overpayment. Now Im still waiting....thank u everyone for your input
