I didn't even know police had to have consent from everyone living in a home before going in. I thought any resident could let in the police if they wanted.

Prior to this ruling LE could enter a residence without a warrant under several exclusions to the 4th Amm. This did not allow them to conduct a search. Even with consent of one resident, like the wife, a husband or any other resident could refuse the search. This is still true except if the refusing resident is legally removed from the residence ie: taken to jail or even at work. Any other legal resident can now consent to jointly shared premises.
There still is likely an exclusion for individually possessed space ie: you rent a room in a friends house, the owner likely can not give consent to that space which you solely possess.
How can they prove who it belongs too if the husband and wife both live there?
I thought if the other resident consented, the cop could only search common areas and that resident's specific private living area. Wouldn't they still not be allowed to search the rooms of the other residents?

Staying on track here. If you have a wife or even a live in girl friend, no space would be off limits. Every room and area would be considered common and thereby fall within the search criteria. Now, a true roommate or renter would have an expectation of privacy to the non common areas such as a bedroom they rent or basement apartment as an example.
As far as the (wife) being charged or proving the illegal items found belong to you, the burden of proof lies with LE to prove possession. Technically if the (wife) was aware of the illegal item and gave consent, she too could be charged with possession (although it's not very likely).
Nah ill pass. Like i said, other than the last few times ive been online, youve usually been more than good, to me and everyone im sure. That doesnt excuse these isolated incodences...when someone does something that bothers me, i let them know in hopes that the circumstances change for the better.
