My girlfriends friend has been dating some drug dealer. The used to live together. Well they just got back together ans she moved back in with him. I'm not sure if she is on the lease of the apartment. Well the cops just raided the apartment while both of them are home. Apparently there was a decent amount of drugs there. Both were arrested.

How much trouble is this girl in? She never sold or bought any. Wasn't involved in his deals. She doesn't even do drugs. But she was living in the house. How screwed is she?

The cops need to prove she knew what was going on there. Advise her not to talk to the police and get a lawyer. If she says in a statement she knew about the drugs, she could be in some trouble. They will probably try to have her in a position to testify against him though and let her off. Don't do anything without a lawyer.

They have to PROVE that she KNEW what was going on. This would mean when they raided the place drugs would have had to be in PLAIN SIGHT meaning that she would have seem them walking around the apartment doing her daily activities. Odds are this guy probably had them hidden and her lawyer should have no problem proving that she had no knowledge of his activities and that he hid it from her. However, if their telephones were tapped, and they ever engaged in a conversation where she acknowledged any type of knowledge about it, she will most likely be charged with conspiracy. Only reason I know this, is that a friend of mine got pinched a few years ago, his phone was tapped for 1 year, and from ONE telephone conversation with another friend of mine who was a girl, they charged her with conspiracy to try and get her to testify on him, but the charges ended up getting dismissed against her. However, with him, when he got raided he wasn't caught with ANY CDS, the evidence against him was 1 years worth of wiretaps, and an undercover Fed was doing drugs with him for 3 months, and buying large quantities every week. He ended up getting 5 years, and served 24 months... He's out on parole right now...

Not sure how it works in the states but in UK she would probably get a hard time in interview then possibly bailed to scare her so that she gives up the boyfriend. The police will be looking for a weak link to use against him and she is it. Very unlikely she would get charged with anything though unless her dabs are all over the drugs bags or some such thing to link her.

However, since she's been with him BEFORE, and he was a dealer THEN, and he probably has a record dating back to that time, they will prolly go after her.

Not necessarily. It does depend on the mental element required for the specific offense (which is jurisdictionally dependent). However, it is often the case that knowledge can be defined in more ways that just 100% knowledge. Often if it is reasonably the case that she would or should know, even if not her actually, then it could be decided that she had knowledge. Circumstantial proof such as how long she was dating him....did he have a job and where did his money come from...etc in order to make a legal inference to conclude knowledge.

Secondly, consipiracy would only be an option if they entered into an agreement to commit a crime (usually followed by an overt act short of attempt/aiding/abetting). However, this agreement need not be expressed or simultaneous. A tacit agreement arrived at through inference will suffice.

This girl went to a catholic H.S. and has never touched a drug. She was sent to a Federal Boot camp for 6 months. If she does not turn evidence, she is an accomplice.

If the apartment was in her name or both of their names, she is an accomplice. The girl that I used in my example got pinched because she turned a blind-eye to what was going on in their apartment, therefore perpetuating the situation. This is not merely conjecture, it actually occurred. So if the judge was wrong in your opinion, I'll get you his phone number and you can take it up with him.
