you can use that as a defense.

there is a big difference between having a camera laying on top of the night stand, and having full photographic equipment and lights in production.

the word "ploy" comes to mind if the camera is simply sitting on top of the night stand. This sounds like a defense that would not stand.

problem with that niche is that all participants may or may not be consenting. You have to know about it before you can legally consent.
