Ok one, if they smelled weed and then they searched the entire vehicle and all its contents, and found NO weed, then the search was bad and anything resulting from it should be thrown out of court, I would focus heavily on that point. The search was initiated under that pretense, have your lawyer rip them apart on the stand. Also, having no front license plate is not probable cause to search a vehicle, which is why he would have needed to say he smelled weed, because probable cause does not protect "hunches." If they confiscate anything on the spot, you need to be issued a summons ON THE SPOT to appear in court, it looks like that wasn't done, another instance of negligence on their part. Next, they need to provide you with a full inventory of the contents of your bag, this is done to prove that they didn’t steal anything from it, if they cannot produce an inventory, then you can actually sue them. I'd say you have a pretty good shot at having this entire case thrown out of court because of the negligence of the officers, any good lawyer should make them look like fumbling idiots on the stand.. A false positive is when a handler gives the command to search and the dog simply acts as though he has detected something (usually by sitting next to or scratching at a compartment) in order to recieve praise from it's handler.

pre-law...i didnt say that the search WILL be thrown out of court, i said it SHOULD...meaning his lawyer may have a slight chance at having it tossed out on that alone, however if not, the rest of the officers gross negligence to follow the proper precedures of confiscating evidence and issuing him a summons should do...honestly the dude just needs to get an amazing lawyer and let him come up with some great bullshit, im not a lawyer so dont take anything I say as solid advice, my knowledge of the law is limited at this point...

the reason i had the gear on me was that i was moving otherwise it wouldnt have been there. it was still retarded, i wasnt even on cycle at the time, but the cops said he knew i was on it when he saw us. and said he knew a guy that did real well in wrestling then got on steroids and tried to kill himself and his parents. and that i should be careful and watch out for suicidal thoughts in myself. i told him he watches too much sportscenter. im currently on cycle right now and im staying on until my court date. or till they tell me i have to pisstest or whatever, the shits still gonna be in my bloodstream though, deca stays in it for like 18 months or somethin. right now im on week 5 and im not wanting to get off, just gonna try and make some more gains before i am forced to do what i have to do.

the cops will have the proper paperwork done (even if they didnt do it at the time). He prob. signed somthing saying what they took the date, etc....

department procedure dictates issuance of a summons and since there was no court date, it is quite acceptable to not issue one.

The easiest thing to do would be to just plead guilty (or no contest if the judge lets u). It would prob. be probation plus a fine. if you're the type that has kept out of trouble this long... just take the guilty plea.

Step 1, turn yourself in (but call a bondsman first so he'll be there to bond u out)

Step 2, show up for your first court date WITHOUT a lawyer. Ask the judge what the sentence will be IF u plead guilty. If you can live w/ the penalties, plead guilty, if u dont like what he has to say, plead not guilty. If u plead not guilty, you'll get a trial date about 3 months into the future.

Step 3, if necessary, get an attorney, and go to trial

they took my entire bag when they got it. my protein, creatine, vitamins, tribulus, gloves, straps, weight logs, mp3 player also took abottle of clomid and cialis from ar-r but i guess cuz they are non controlled drugs im not getting in trouble for them. they didnt issue me a damn thing. they said i could pick up my stuff on the following tuesday. i went in and they gave me my straps, gloves and mp3 player back and kept everything else. they did fill out an inventory of the things they gave me back on that day, but nothing else in the bag. and they did not give me a copy of anything. i still have no papers or nothin from them.

even if you get charged the max, it is for personal use and the charges will get lowered. waaay back in my dumbass days i got caught up selling shrooms on school campus and got 9months probation, this was felony sales and even worse since it was at school..... try to fight it, but i wouldn't sweat it if you got punished.. you have a lot of angles to fight it, make sure you tel the cops nothing and your lawyer everything.. best advice i can give is to never talk, that's how a lot of ppl get taken down because they are scared.. they will try to scare the sh1t out of you, but this is usually because they don't have enough or want more on you..

Dude, cialis, clomid, and clen ARE controled substances... u only get them without a perscription because they are for "research". My buddy got caught with a kilo and 15k X. He walked with 5 yrs probation.. One thing saved him his attorney said. He never said a word but give me my attorney. cost him 25k but avoided mandatory 15yr sentence..

And bigs, they are controlled substances, they just don't meet class 3 criteria, so while they are illegal to posses without a script they are rarely prosecuted. Do what ever you can to keep this out of the range of being a felony, don't screw the rest of your life over being too cheap or too scared to get a good lawyer or your folks involved if you need them-long godamn time to be branded a criminal.

i didnt consent to a search, the only thing i consented to was that they could call a drug dog in to walk around the car. and i didnt even consent to that, the guy that was driving his car did. when they couldnt find anything after they tore the car apart thats when they went for the bags.

First get a good lawyer, and talk to them. They will probably advise you to turn yourself in. You'll need $1000 to bond out, make sure someone you know has it since you can't bond yourself out. If you get a lawyer who is familiar with this then you probably will win in court and not do any real time or pay many fines. Either way you are looking at lawyer and court fees. Get to a good lawyer ASAP, you do not want to wait until you are arrested.

You need a good lawyer. Yes, it would help if this lawyer had experience with your situation, however, it may help more to get a good lawyer who can negotiate with the DA. I would be highly surprised if the DA would want to take a case like this to court unless he has nothing better to do. This screams of settlement. Can you say community service??
