Couple Charged After Trying To Sell Baby To Convicted Child Molester

Indianapolis, Indiana – Four Indianapolis residents have been arrested, accused of trying to sell a baby.
Police say 36-year-old Rose Faucett and 58-year-old Phillip Hester agreed to sell Faucett’s daughter, born April 2, to 57-year-old Michael S. Overby and 50-year-old Debbie Overby. In return for selling the baby to the completely normal looking couple, they would get a whopping $300 and a place for Faucett to stay.
All four have been charged with neglect of a dependent and child selling. Michael Overby was also charged with forgery for falsely signing a paternity affidavit, claiming to be the biological father of the infant.
The real kicker here is quite disturbing; Michael S. Overby is a convicted child molester and Debbie Overby has been convicted of child neglect in the past.
“Mrs. Overby is currently on probation for neglect of a dependent, and Mr. Overby is a convicted child molester. It’s a charge from back in 1984,” said Indianapolis police Sgt. Linda Jackson. “We don’t know what the intentions were for trying to adopting this child. It may just be that they are both convicted felons, and they can’t legally adopt a child.”
Police are conducting paternity tests to confirm that Phillip Hester is actually the child’s father. Their scheme fell apart after a relative of the Overby’s, and with a bit of common sense, blew the whistle. Debbie Overby has been released on bond while the others remain in jail.

I read a story of a couple the other day who had kidnapped a girl at 11 years old and kept her captive for several decades never attending school etc. As part of the plea agreement they will not seek the death penalty in exchange for the victim not having to testify. There is something so wrong with a legal system where a lawyer will threaten to have a victim take the stand for weeks on end so that they can exchange release from this further torture for a reduced sentence.

It seems clear in a case like this that all one should be able to do is question the defendent asking,

Is this the couple that kidnapped you at age 11 (YES)
Did they then keep you captive for 20+ years (YES)
Were you molested by one or both of them with the other parties knowlege (YES)

IF that is not enough testimony to convince a jury that any and all punishment available in that state is justified then I don't know what is required.

I understand rights to cross examination and its importance but in a case like this where there is a multitude of other evidence linking the offenders to the crime using the threat of cross examination to reduce the sentence puts the lawyers in the same class as the pedophiles they are both child abusers ( Well not in this case since the victim is now in their 30s ).

I really do believe in due process when it is needed to prove a clients innocence but when a lawyer knowingly uses it as a tool to protect a quilty client then the lawyer is just another criminal.

the alleged mother was only 38... the woman trying to buy the baby was 50.. which is probably the reason she is trying to buy a kid.. sense they can't adopt since they are felons.. If he didn't have a molestation charge from a while ago i would not be that disturbed.. if it was say some other felony from 25 years ago i would say that they should be able to adopt.. but if you were a child molester i think you should be executed in public.. those people are sick in the head.. they will always fantasize about fvcking children.. they are not wired properly.. just think about it could you stop being attracted to women if the court told you to??? no.. you would just stop hitting on them in fear of getting caught.. same for these child molesters.. and even thinking that way deserves a slow painful death IMO.

If the person has a history of violence then no they shouldn't be able to adopt. There could exception made for example: making the person take classes for whatever they did and have a waiting period before they can adopt.

you are completely missing the point.. all i was saying is that there are a lot of Felons out there that did things when they are younger and have changed. I agree that a violent person is always a violent person.. classes do not fix that. I am not comparing gay people to criminals.. i am comparing the argument that classifying all Felons as violent people is the same as saying all gays are unable to control their sexual urges... they are both retarded arguments that hold no weight. My previous examples are examples of non violent felonies.. and i question your judgement that any of those examples should not be able to adopt due to minor mistakes that stay with them for the rest of thier lives even if they were done when they were kids..

Where did i say anything about it being better to let the child molesters adopt the kids compared to two adults with no record?? I AGREE WITH YOU that violent and sexual related felons SHOULD NOT be able to adopt.. but I DISAGREE that someone who sold weed in college, or got in a drunken car accident (all felonies) should not be able to adopt a kid..
