No the states have the right to make laws, the laws just cant contradict the constitution. State law was orignally intended to be self governing with the constitution as a framework of how the entire nation as a whole was supposed or is suppose to operate. Federal law supercedes state law as it pertains to criminal prosecution. For example california has laws on the books that allows for some medical treatments that federal law prohibits. California's law itself is not being challenge but if the federal government wanted to they could go into California and prosecute those individuals in federal court even thought state law allows it.
So much for the states having power.
