well small town is worse because they probably have nothing better to do. Yes you will prob loose your license, that would be the least of my concerns.
why did they search your car? Did you give them permission? is it possible the search wasn't legal and a good lawyer can get it thrown out?
    i from jersey too

    Jersey or new jersey?

Jersey you walk, I don't know why they even arrested you in first place

My bad its new jersey isn't it, nevermind the above

Get a good lawyer... then prepare to wait, and wait, and wait. The legal system moves slowly, and it will be in your best interest to have it move even slower.

  10. #10
Can i ask why it would be better to move slow? Why would my license be least of my concern. I dont mind probation and a fine. If i cant drive i lose my job and home. And thanks everyone for the replies. And its hunterdon county new jersey. Rich man land. Im not but most are. Would this be foolish to try to save thr $1500 plus on a lawyer and represent myself? They (the police) said i definatley wont get jail. I feel like this is end of the world.

Plus they have my court for this week already.

Nothing will make your head spin faster than trying to represent yourself. It moves fast, you won't understand the rules, and the judge will always error on the side of the prosecution. I have a prelaw back round and attempted to represent myself after months of preparation. It was not pretty.

It is advantageous to draw the legal proceedings out for many reasons. The longer it goes the better the plea bargains get, witnesses stop attending court and/or die, if there are personality conflicts between you and the cops that gets alleviated with time, and you have more time for " discovery" where you learn the extent of the states case .

Worry less about your license and more about the other penalties your likely facing. Be prepared to be charged with outrageous felonies. The cops always over charge to give them the upper hand in the plea bargains that will come later. So the good news is that whatever your immediately charged with you with more than likely not be convicted of.

I would also prepare for a search warrant.

Traffic stop in middle of night on way home from work. I had in two spots and he found some on me so when they asked for consent i approved because i figured they would just get a warrent. The truck smelled of weed. He pulled me out and had handcuffs on me in 10 seconds and would tell me why. Then when he asked if i had anything i said yes cause it was in my pocket and he was gonna find it.

no offense but what were you thinking? driving around with a truck smelling like weed, with pills and juice on you and then apparently breaking the traffic laws.

That's fast!!! I would get a lawyer asap. 1500.00 for an attorney is a small price to pay especially if they're charging you with felonies!

    Is the hearing your preliminary?

^^^^Agreed. I would think 90% or more people that get caught is due to driving around with it on them. From now on leave it at home, but as Xel said...For Now I would clean house just to be on the safe side.

That's the reason why I never advise using a PO box or dead drop that requires driving to for your package. It just adds an extra chance to get busted.

Trust me i asked myself the same question. What was i thinking. I wasnt and never would do that. Most law breakers make mistakes, and i did. I dont denie how sttupid it was. But with stupidity aside i have to fix what is done. It is personal usage.

You need to get a lawyer. Your judgement was flawed the evening you were busted, and its flawed for considering representing yourself.

Well im not saying it wasnt stupid. I wasnt thinking. Just like most law breakers, i made a mistake. With my stupidity aside, i have to fix a problem.

  26. #26
It gets worse. They found a gram but i hadnt smoked so i dont know how he smelled it. Within 1 min of being pulled over i was in cuffs. And he hadnt said why or read me my rights

They don't have to read you your rights till they feel like it. A cop can talk to you as much as he wants ON THE RECORD and not read you your rights until he's ready to arrest you. EVERYTHING you said prior to getting your rights read will be written down and presented to the court.

they can cuff you before reading your rights. how old are you? Sounds like something I may have done when i was in my early 20's. Sorry man. Yes they can charge you with felony possession. You absolutely NEED a lawyer or you will be screwed. Get a good lawyer because it will be worth every penny.

If your hearing is your preliminary, did you know its advantageous to waive the hearing? Doing so will curry favor with the judge in the long run, and send a signal to the prosecution that your acting in good faith. This inside information is the kind that a lawyer will have.

No you wont get jail. Specially these days. More charges may follow. They will have to lab test whatever was in the bottles in order to charge you with them.

Anyone have an idea of what ill get. More than a year probation? Over $2000 in fines?

This is an AAS forum. You should speak to an attorney instead of asking questions we can't accurately answer.

Get a lawyer..delay the hearings and go from there brother. That's all you need to know and your lawyer will answer most of your questions. I'd get on it ASAP

Listen to the advice that keeps popping up here dude, GET A LAWYER.
A lot of what you will "get" - or won't has to do with how you're represented.
Next time (if you're that dumb, no offense) say nothing, admit nothing and never consent to anything. That goes for any time a cop detains you. Do it respectfully and politely, but never help a cop build a case against you.
