Anyone who knows the law can you help??

My friend was busted in Michigan with 1cc of QV Test. The police said it would take up to a month to test and find out what it is. What are they lookin for when he told them exactly what it is, what are the possible charges he could face it was in a syringe lyin on his back seat. The only problem is he is goin to be a police officer and he doesn't want to get charged and have a record. Thanks for the help everyone !!! FYI He is canadian ahd this happened at the border crossing and it was the mich police who he has to deal with.

i dont think the charges would be to bad,but.....why people leave that s*** in their car is beyond me,and if he is wanting to be a police officer,i would of thought he would have known better.....

I'm in michigan, I wish I knew what would happen.. Probally cut him a deal, they're not interested in the 1cc, they're interested in where he got it.. I think thats what usually happens.. If he rats on someone he'll get a lesser charge.. I honestly don't know if he is a canadian citizen.. 1cc of test is obviously personal use, and wouldn't be a very heavy charge..

If it was the staties I doubt anything will transpire of it... it was merely posession. If it was the customs officer on the other hand your buddy may be in a world of **** as he was by definition importing.

But crossing an international border with a loaded pin on the back seat of his car? WTF is wrong with your buddy bro? Geeez. It's not like it's something that would slip ones mind!?

Tell me about it... since 9/11 American customs officers have turned into certifiable psychos... most of them make the Gestapo look like kindergarden teachers...

Sadly for many American border towns it has meant tourism death... many small town along the Quebec border used to live off Canadian tourists and cross border shoppers. Many (if not most!) of those small towns are now on the verge of bankruptcy as the tourists aren't coming anymore. Crossing the border has become such a pain that we don't bother (I mean lets get serious, if I am going to another country to spend money and get treated like a criminal and harassed at the border by some two bit customs officer on a power trip... screw that I'll turn around and spend my money at home).

Of course that doesn't excuse crossing borders with gear in your car.... geeez!

Yes, sorry for inconvience Red. Us Americans are very paranoid people, the most minor things seem to make us nervous. No inconvenience to us bro... none at all... as a matter of fact it's helped our economy by keeping most of the tourism money in our country.

The only people inconvenienced in this are your fellow Americans who made a living in those border towns... they are the ones hurting from the over-reaction from customs.

If they said they are going to test it. You can count on it. MSP is responsible for many forensic responsibilities. They have a lab dedicated to testing. So if they say they are going to test it....they are going to. Wont be a problem for MSP.

As for criminal record. If he's canadian. Will not affect his status in Canada. As far as my knowledge goes. Canadian crime depository does not reflect the United States crime depository. This will be held in a federal court though and put on a master arrest record in Lansing. Canadain possession laws for AS is different from the U.S. so how it will reflect on him being a canidate for law enforcement is questionable.

At most, for this amount with no criminal record he might get it taken under what Michigan calls Chapter 14-11. It's a type of advisement where it is under review after a one year probationary period. Then with a guilty plea it will be submitted without prejiduce as "dismissed" but submitted to the CJIC (Criminal Justice Information Center) on his master arrest record. This is permanent but not viewable to the public and not within rights of the freedom of information act.

Only govermental and other law enforcement agencies in a criminal search can or will see it. It will not come up on a LEIN (law enforcement information network) search. Which is that computer in the cruisers. Although there is a way to view records online through mich.gov or MSP website now...not sure.

This is a rare case where if he lies and sais he has not been arrested. He might get away with it. United States has extradition with Canada but as for the records reflecting each other. I'd say no.
