    well, it wasnt an order........my buddy was relocating a bunch of his stash to me....bc he was going to be moving there for about a year, and then moving overseas....it wasnt like it was from a website with tracking or anything.....

    No i dont have that much....RIGHT NOW!!!!!

    So on what conditions did they get the warrant? Having stuff in the usps addressed to you or your residence, even if the stuff is illegal, is definitely NOT sufficient for LE to obtain a warrant.

    Did you use the FOIA to see what info you could gather? Did your friend get pinched and rat you out or something?

    Bump for jstraw328. This is important stuff man. Under what conditions was the warrant issued? How did you get made. Why were you targeted? Who knew? Who ratted you out?

    Cops don't get warrants b/c someone finds an illegal item in the mail addressed to a certain person. If that were the case narcotics dealers could simply mail all their competetors some and snitch and bang! overnight they are running the whole shebang.

    You are correct. There is much more to this story in my opinion then what has been told.

    A RAT is definitely in the story I'm sure.

    there was no rat......all the gear was my buddies.....the reason he sent it to my place, is that he was moving there for about a year, and then was moving overseas.....
    He overnited it FEDEX.....The package never made it, but it was listed as delivered by the tracking number.....i thought it might have opened, and the driver saw what it was and took it and scanned it as delivered......

    When that happened, i got all of my gear and needles and aas related stuff out and kept it at my gf.......about 2-3 weeks later, is when they came through the door....i was in the bedroom bathroom doing something and guess i didnt hear them knock, so they came in......;they told me they had a search warrant for my car and the apt....

    I asked them what for, and they said a random search at the airport, flagged my package.....they inspected it and confiscated the gear....sending drugs through the mail, is a federal offense.......They said with that amount i must be selling......they then turned up nothing in there search, so they had to drop it.....

    Sending drugs through the mail is a crime, yes. But you did not do that, your friend did.

    You can not be held responsible legally for something another person does that you know nothing about, were not present when it was done, there is no evidence to demonstrate you coordinated or collaborated in having it happen, etc.

    If I mail steroids to you or your next door neighbor *I* am breaking the law. You nor your neighbor have no idea what I have done and there is no evidence that either of you know what I have done.

    This story sounds very whack. It doesn't add up.

    They need more than a package of steroids with your name on it somewhere in the postal system to get a search warrant.

    Of course if they did something like ran finger prints on the gear and traced them to your buddy and then told him "your going down but you can make it easy on yourself if you tell us xyz (i.e. rat you out) and sign an affidavit to that effect we will knock back your charges" and instead of keeping his mouth shut he ratted you out, even if it was made up shizat, maybe they could.

    If there is $1,000,000 worth of gear in the mail system right now with my name and address on it that is not sufficient evidence for any LE to get a warrant to search my house. I don't care if the head of the DEA is staring at the pallets packed full of gear addressed to me. He can't get a warrant to search my house based on that.

    That does make sense actually. If that was not the case, the police could search any place they wanted. Heck the LE could THEMSELVES mail you a phony package full of gear, then intercept it, get a search warrant and search your place

    I still had to get a damn good lawyer to have the package evidence thrown out, I kept saying i did not know the person sending the package, and that it must have been a mistake....I spent about a buttload of money to get off......This was about 5years ago, and it was in court for about a year.....

    What 'package evidence'? Where the hell was the package? I thought it never made it to your house?

    If some DEA agent comes knocking on my door and says "Hey pal, there is a semi full of gear out hear shipped from mexico with your name on it" I'm gonna say "Officer, that conversation doesn't interest me" and close the door on him.

    I think your either making up a story, adding stuff to it, keeping stuff out of it, or you got ratted on. It's as simple as that. A package with your name on it doesn't mean jack. And it can't be 'delivered' and also in the hands of the cops or fedex for 2 weeks simultaneously.

    I know this story seems messed up and full of holes........I was never a juice dealer, i just was an unlucky guy trying to help out a friend....nothing more.....

    Yes, it can happen with one seizure.....If law enforcement wants you, they will come after you.....

    IT WAS A DOMESTIC SHIPMENT......so dont think just bc you get your gear shipped within the states your safe.......

    I got lucky in the end....the only thing i lost was a lot of money and i never did talk to my friend again....

    Well they wanted the guy who sent the package, but i would not give him up.....I aint no snitch.....I knew the risks associated with what i was doing, and he was going to compensate me....But things took a different twist....I never did turn him in, but i also didnt get in trouble.....Just a lot of money down the drain with legal fees and about a year wasted in and out of court...

    Law enforcement does what it deems necessary to catch criminals....It just sucks i had to be that guy.....

    With that much gear, they have intent to manufacture and distribute.....this gives them the right to obtain a warrant to search the premise...sending drugs through the mail is federal, which means they have a bit more power than just local police....

    I dont care if yall believe me or not, it happened, I was there, and it was not fun....

    The picture is becoming a bit clearer now. But YOU did not send drugs through the mail! And they could not prove you did. In fact, from what I gather, they did not even SUSPECT that you did.

    You are breaking NO LAWS having drugs in the mail addressed to you or your residence. Do you know how many drug dealers would mail their competition drugs through the mail then snitch them out to expand their own business by getting their competition arrested and put OUT OF BUSINESS? How many jaded ex spouses would mail something through the mail anonymously to their hated ex and drop a dime, how many disgruntled employees, how many unhappy business partners, etc would do this and drop a dime if this were the way the law worked?

    It's starting to sound like your bud was a known suspect under investigation at a minimum based on the updtates you provided.

    You should use the Freedom of Information Act to find out exactly what conditions were present and what testimony was given to the judge that he based his signing the warrant on your premises and car.

    And how much time did your buddy do? There is still a possibility (no disrespect I'm talking in general) that your buddy tried to pass the buck, or at least part of it, on your ass to get out of some stuff himself, reduced sentence and whatnot.

    Look into what they had to get the warrant. A big package of steroids addressed to you our your house at the airport is NOT enough. That is why they do controlled deliveries or try to get confessions, or if they suspect an active distribution operations that may trigger their opening an investigation to gather evidence which will later be used to get a warrant and arrest. But the package IS IN NO WAY ENOUGH. Not in the USA, at least not yet. They need MORE.

    I did not get in trouble, and the only thing i lost was a lot of money and time.....i am done looking into it, bc it happened like 4 years ago.....Since they dropped it, i felt i needed to do the same....whats done is done, No use crying over some spilt milk, or in my case seiezed gear....

    I dont think they suspeceted him before, just when package was seized, it was so much, they wanted to knowwhere it was coming from....Oh well, live and learn...


    I hope my story has enlightened some of yall, on the risks associated with sending gear through the mail....Domestic or international, it can all be caught....

    I'm still with 40plusnewbie. Gear does not get seized without reason, nor can they get a warrant, ESPECIALLY domestically.

    All the story is not being told.............

    well if there is more to this story, i dont know it....They said fedex flagged my package, and it was then searched.....With as many tabs/caps as was being sent, i am sure it had a bit of a smell....They have dogs searching the overnight packages all the time...I know, bc i used to work there.....

    You guys have no idea, of how many packages are opened and examined for random searches.....They do it all the time....

    Do you know what they do when they find 1 kilo of that stuff from colombia in the mail addressed to someone? They DO NOT get a search warrant. They do a controlled delivery. They CAN'T get a search warrant. Not even if it was 100Kilo's. They need to nab you for possession or prove intent. The package in the mail with your name and/or address on it is NOT enough.

    So what they do is get a 'conditional warrant' which stipulates that if and when the package is accepted (the party takes possesson), and usually they like to do this by asking for a signature even if it was not sent registered because the signature is extra hard evidence if it goes to trial. Sometimes they rig packages with little devices that allert when they are opened and rush in with a raid at that moment.

    But they really don't want to deliver anything and then hang around too long without acting on the warrant b/c you could slip it through a floorboard to your upstairs neighbors apartment, and apartment they don't have a conditional warrant for.

    If they show up and ask you to sign and you refuse and say you never ordered anything from x and are not expecting anything and refuse to take possession, they will try to trick you, try to get you to take possesson, but if you don't they are stuck. The conditional warrant DOES NOT take effect, hense there is no warrant. There is no charge. There is no arrest. They might try to trick you into confessing, but if you refuse the package and keep your mouth shut you are home free. There is nothing they can do (except break the law and lie and said you took possession, etc..)

    If you do sign, or take possession, based on their intelligence and general operating procedures they go in. They like to go in quick. They don't want to loose the evidence.

    You guys can talk about what can and should happen all you want....i was merely telling yall what actually happen....I definitely dont agree with how all this went about, but like i said....all i lost was money, and time in court.....i am not behind bars, and i am thinkful for that.....

    The point of me telling yall this is this.....LAW ENFORCEMENT WILL DO WHAT THEY WANT, WHEN THEY WANT....AND IF THEY WANT TO BUST YOU BAD ENOUGH, IT SEEMS THE RULES DONT APPLY.....I am not saying this to scare anyone, as i still receive gear through the mail....i am merely saying b careful....
