With great fanfare and a free Angry Birds download, Amazon opened its Appstore this morning. This is despite a cease-and-desist order and federal trademark lawsuit filed by Apple computer over the use of the name “Appstore”. Amazon Appstore opens
The Amazon Appstore, a store for Android applications, opened on Tues. morning. Right now there are a lot of apps in the store. The android based phones and tablet computers can now get about 3,200 new apps there. The most Android applications in one place are found in the Amazon Appstore. This can be a definite plus. Typically an Amazon Appstore App will price between 99 cents and $4.99. In the Android Marketplace, the developer sets the cost of their program and hopefully does well with it. In the Amazon Appstore, the price of the developer can be requested although the store chooses the price ultimately.
Apple angry at Amazon for Appstore meaning a lawsuit
Apple filed a lawsuit on trademark against Amazon right before the Appstore opened. Apple is mad since the “App store” is a trademark. Apple states Amazon is violating that trademark. The lawsuit originally claimed "unspecified damages" for the brand violation. The Appstore was opened anyway while Amazon ignored a cease-and-desist order. This is not the only lawsuit over use of the term "App Store" -- Microsoft currently has a pending trademark lawsuit against Apple Computers, claiming that the terms "App" and "App Store" are too generic to be trademarked. The lawsuits will take much longer than everyone could hope. It can be years before anything is decided.
Appstore lawsuit will mean consumers have to pay
The federal brand infringement legal cases currently pending are expected to take years. These federal lawsuits are heard in courts that are paid for and operated by taxpayer money -- bad credit loans not pay day loans given by tax money to the courts and paid back with "court costs" charges. The cost of the businesses ends up going up with the “hidden” cost of the lawsuit, which consumers end up paying. There is a very low likelihood that the app costs will go up. No matter where an app developer works, they're typically willing to do things for very little. Sometimes they are even willing to do it for free. The “App Store” lawsuit might turn out to be a huge problem financially just due to what one company want.
