Well accepting money after hours for a
tip that is not split between all of the dealers is against the rules. However if you read my post you would have realised that we did not recieve a
tip for her winning, we did not recieve a
tip because we dealt good cards to her, we did not recieve a
tip because she liked us, and we did not recieve a
tip for any service we as
employee's provided her. WE did however recieve a
wage for a service that we provided on our own account.
The definition of a tip is as followed!
TIP: give a tip or gratuity to in return for a service,
beyond the compensation agreed on; "Remember to tip the waiter"; "fee the steward"
She had originally offered the ammount of $400 dollars to the other guy so it was not an amount beyond what was aggreed upon.
Definition of WAGE: a rate of payment for
work. Work being what we did for 3 hours taking her home.
Also a taxi ride of equal distance would have cost her 228 dollars, 2.50 for the first 1/8 mile and .25 each additional 1/8 mile. Not to mention we took her vehicle home also. On top of which it was a snow storm that had closed down the highways, so if we would have got stuck they would not have sent out a wrecker. She wouldn't have offered the $400 if it wasn't risky, she would have drove home herself, she was sober. You know as well as I do that risk factor adjust income earning potential. Exactly why military gets eminent danger pay in Iraq, and Offshore oil rigging pays more than oil rigging on land, same reason underwater welders get paid more than normal welders. So with the standard flat rate of any taxi with the addition of risk involved taken on behalf of myself and this other guy $400 is not an astranomical price.
They employee handbook states: (This is what the terminated me on) "It is specifially prohibited for any employee to ask a guest for a tip, imply that a guest give a tip, suggest in any way that guest give a tip, or indicate, in any way, that a tip is isufficient.
Providing and/or accepting a loan from a guest, vendor, supervisor, subordinate, or employee is prohibited.
All employees shall avoid acts and situations which are improper, or might give the appearance of impropriety, or might impair their good judgement when acting on behalf of the company. This includes accepting gifts or loans from guest, vendors, and supervisors.
The definition of a GIFT:a donation, a present
Definition of a Donation:a gift, a contrabution
Definition of a Contrabution:Give with others, as to a charity
Definition of Charity:1. the quality of sympathetic understanding: 2. an organisation devoted to the relief of the unfortunate.
So as you can see what we provided was a service, and what we were paid was a
WAGE for that service we provided. We were however not
Tipped and there is no where in the employee hand book that states we can not recieve a wage for services provided outside of work. Only that you can not recieve a gift, loan or imply that a tip is need, or insuficient.
That is why I have a problem with getting fired. I can back up my statement with Truths and definitions and its clearly in black and white in the employee hand book. Ohwell I guess we will see what the lawyer has to say on Tuesday. Free consult
