    You are right. But a good lawyer can fight that. If you give consent there is nothing you can do later. You have nothing to loose

    It's going to be his word against to police's word. The police can easily say the suspect made a suspicious move.

    Back to my first reply, NEVER carry anything in your car that's illegal.

    and that easily gets thrown out in court. if an officer doesn't follow strict protocol they dismiss the case. yes it is your word against theirs and a jury and judge will always side with you if you say that the cop denied you of your Constitutional rights. I've denied a cop the right to search my car before, and all they did was follow me home.
