    Just because a court says you aren't liable by reason of mental defect doesn't mean someone won't kick your ass for it. Justified.

    Legally , its justified since he inflicted harm on the child first. I guess its more of a moral question.

    I guess the dad's natural instincts took over. Although the kick was pretty weak (the child was still standing and didn't appear to be injured), I think the father was justified.

    thats how i felt when i was in my early 20's...now that i'm getting closer to 30 i realize i do want kids before i get too old.

    perhaps not, but i dont generally see myself punching a kid with downs syndrome in the face because he kicked my kid.

    Guy deserved it. A lot of people think they can do whatever they want because they have a disability. And if people are going to tell me he didn't know that kicking a 4yr old for no reason is not ok then get a life.

    im prob going to be smart enough to realize someone didnt do that just for the hell of it, there was a reason and it didnt hurt the kid, there was enought time fore him to see that it didnt hurt the kid and the mother, caretaker was getting the ds kid. i would prob have pushed the kid far away from my child but that punch was un called for in that situation imo

    DSM, you title this thread.... justified?

    there is no justice in either case...imo. it was a bad ordeal... based on the video it appears that the dad did not have enough time to know that the guy had a mental issue... his back was to the kid and he was on the phone, then turns around and kicks the kid.... the dad reacts like most dads would...

    in the end it is just a bad deal for everyone.... the guy with the illenss and the dad probably fel bad, but where does that leave all this?? nowhere imo... just a bad experience for all. maybe the mother of the DS kid could have prevented? maybe the dad overeacted without assessing the situation? who knows, but who can blame anyone...

    I only have to say bad experience... I am a dad and I ave experience with people with those type of disabilities, so imo, no one is at fault... just a bad experience for everyone that was there.
