Thread: it's not working out with my gf, how to I get her to move out.

    This could be considered harassment. If you want her to move out you need to serve her the correct papers. If she feels threatened she could file a restraining order that would keep you out of your own home. Even if you don’t live there you still have to provide all utilities that you have provided in the past and rent. If you don’t provide all this she could sue you. Crappy thing is judge would more than likely rule in her favor.

    Thats a bit extreme. In order to get a restraining order she would have to show immenent danger not just a general PITA! As far as providing things if he is not living there..that would be civil matter not a criminal one.

    Since she is not on the lease...have the landlord remove her. I dont know if your lease allows you to sublet so she/you may be in direct violation of the lease. I still say move her out and change the locks...it's not illegal!

    Bottom line here. The landlord may be able to do this so try. Better yet you MUST take action now. First do not change the lock. I have been through this when me and the wife were separated. I was stark naked (don't ask) when a roommate (he held the lease) locked me out on the carport. I yelled open the FKN door now or I'm coming thru it! He not open!! SO I came thru it. Took the jamb off , took the door off the hinges, Scared the sh!t out of him Ha... Anyway the cops came he accuse me of being insane and my meds do it. I showed the cops No. They told him he could not lock me out, he could not change the locks and because he welcomed me in and all my stuff was there he needed to behave and leave me the FK alone. I could come and go. Now the told him to remove me he had to do it legal and go down to city hall and start eviction proceedings. Only way and had to wait until they took her out. No I don't give a hoot what all they are telling you here about do this or do that. Get your a$$ in gear and take action (LEGAL). Get a attitude of acceptance be good to your self and do the RIGHT thing. Now the herpes crap is just stupid. Figures coming from an antagonist. But take care of her at the same time you take care of yourself. You did care for her, so let her be notified with no choice and e forced to do the only and right thing. Have the serenity to accept the things you cannot change (right now) and have the courage to change the things you can. Have the wisdom to change the things you can and take affirmative action. ...good luck bro,. ....crazy ? mike

    Yes Mike...she could gain access through force if he changed the locks and there would be no legal recourse but...playing the odds, I doubt she would and may just give up.

    My point though, Whatever happens. He should get off his a$$, (I shouldn't be like that) and go down and get it all moving. This will protect him for any future legal problems. It will get here moving. He will JUST HAVE TO put up for a month. Concentrate on other things ( if can) get more involved with work, diet and workouts, or hobbies. Ya gotta put up sometimes at least be patient. Look to the future, be grateful for what you have and how much better it will be. It will come, but in God's time by and with your affinitive action. Using the spiritual principals that one should live by you will overcome and be a better man. You will be happier with self.

    If you go to legal finder and put OP information into it this is condensed version of what the lawyers there state should be done and what could happen if you don’t. Have you ever had restraining order filed on you? They don’t have to prove anything. You have to prove that you didn’t do anything to warrant restraining order. That’s the way it is here in Illinois.

    If you go to legal finder and put OP information into it this is condensed version of what the lawyers there state should be done and what could happen if you don’t. Have you ever had restraining order filed on you? They don’t have to prove anything. You have to prove that you didn’t do anything to warrant restraining order. That’s the way it is here in Illinois.
    Restraining orders, protective orders and no-contact orders...it's all the same. Just different terminology. I have PLENTy of experience with them. Here one must prove that they are in danger or they would be handing them out willy nilly all day long.

    Hmm. In Texas, a restraining order protects you in a certain area. Protective, protects you at home, work, phone, electronic communication of any kind, etc...

    Big difference.

    Yeah...damn state by state laws. Ours are called no-contact orders and you may not have any contact by writing, in person, through a third party, through phone ar anything anywhere. They arenot easy to get though. Like I mentioned..immenent danger needs to be shown. We even take all guns from the person served the order.

    Yes and it didn't pass. My friend owns defense company. He put several hundred people through Florida concealed carry classes so that they would be ready when law passed. When law didn’t pass his phone blew up. Over half of the people he trained have called and want their money back.
