Not true, many people are not booked or arrested untill indicted by a grand jury.

    1. Get a lawyer.
    2. Did you sign a consent to search form? If not, testify you do not recall ever giving him permission to search.
    3. Get a lawyer
    4. No good comes from letting anyone search you without a warrant. If they have probable cause, they would not have asked. In the future enjoy your constitutional right to unlawful search and siezure.
    5. Get a lawyer.

and MMA is right if you gave consent to search your car you likely wont beat the illegal search rap. only way to do that is to really persuade the judge or jurors that you were under duress when you were asked, and you thought there would be negative consequences (blocking your car in with cruisers, having a gun in your face, etc)

I said it once and I'll say it again "DON"T CARRY GEAR IN YOUR CAR OR GYM BAG". As far as the search goes if a cop wants to search your car he'll find a reason or he'll just do it anyway and then lie in court about it. Get a good lawyer if your future job depends on it.

It nots that easy. Its a cops word against his. Who do YOU think will win?

if you were never given a ticket when you got pulled over, and if you never signed anything stating that you possesed the steroids , then why dont you just deny everything?

thats why i said deny everything, if there was no paper work, if he was not taken in, and all that happened was a verbal warning, then there is no case

Look I am telling you the law is as much about politics and power as it is the law. If you find the right attorney and you have no priors you will be able to deal this down to a misdimeanor. You need to find someone that is connected. A past prosecutor or judge that practices criminal law.

No ticket and no signature for the gear. How can they prove it was you? They would have a hard time proving the chain of custody on that gear.

Of course, price is dependent on if you actually go to trial or not... if not, although i dont know atty. fees in the dallas area, you should pay around 2k for a decent lawyer.

the one i talked to said 1500 for retainer than 1000 extra if it goes to trial, which he doubt it would. all the fliers in the mail were talking like 700-1000 but i figured i go with him since he has ref's. my buddies aunt and uncle use him in dallas all the time.

find the one you want and pay him what he wants period, you may get some back but I can't see anything less than a 5k retainer for a good lawyer.

no!no! do not do it that way . Are your buddies aunt & uncle going to criminal trials often? You need someone who specializes, not a generic civil attorney.

I guess us New Yorkers think the same, was about to write the same thing,,,,cops can make any reason they want to search your car, it smelled like pot, you were swirving, etc. They make up there own rules, and lie about it in court. Get a good lawyer, and he will prob. work out a deal with the DA on the side if he is good. Goodluck bro.

i really hope you guys are right about the no ticket being an issue. the cop had the right i guess to not take me to jail, but he pulled me over for speeding and he didnt give a ticket for anything. i really thought he was going to keep the **** for himself cause i had 2 open bottles of test and he just kept the winnie bottles because they were sealed in plastic. from what i hear he did he put it as a case at large untill they tested the winnie he took from me. now the charges are a class 3 poss of stanzolo 28 grams but less than 200. im not sure how they figure that but that is what the secretary read to me. the lawyer im considering called down there got what he could but said the grand jury was still looking at the file and there wasnt really even a case number. he said when they get all toget her he will want to see the police report first to see if i have an out

Dude, it's 2 vials of Winny and some viagra. If a DA wants to go to trial over that then he/she must have more time one his/her hand than China has rice.
VERY VERY likely it will be a plea given the fact it is so little and he has a clean record.

That guy messed up, I really would like to see the report. You didn't even sign for it? How can they link it to you? This has holes as wide as a bus in it. You should be okay, just have to go thru the process that's all.

Quick question: Did the cop ask for permission to search your car or was in incident to your arrest since you were DUI? There is a difference between giving permission and an involuntary search such as a search incident to arrest.

ok in canada before a cop can let you go he has to give you a notice to appear other wise he cannot pursue charges. in most cases they just confiscate the sh@t and let you go it means they're not pursuing. in canada they have to have probable cause to search your vehicle otherwise if they do it without permission they cannot charge you on it. i know a guy that had a loaded 9mm and about a 1000 worth of marijuana and they still couldn't charge him. they can pull you over anytime they want and right it off as a routine traffic stop or liscence and registration check. if i were you i would look into how and why your information was released to a law office without your consent.
