hit and run car accident *%!@#
Would like some opinions on this
I was driving on a two lane road (35 mph speed limit) in the right lane. An older woman was in the left lane Parallel to my car. There were cars in front of and behind my car. The woman next to me swerved about 4 feet into my lane. My reaction was to lay on the horn and avoid contact with her vehicle by moving to the right. My wheels and part of my bumber contacted the curb.
I motioned for the woman to pull over, she refused. My reaction was to pull in front and signal her over, again she refused. I wrote down her plate along with a description of her vehicle. I pulled off into a parking lot and contacted the police. Police took my info. and I headed home.
The police Identified the woman (87 years old) and I contacted my insurance. Her insurance company asked me to get an estimate, I did. ($800) I waited a few weeks and got a denial letter. WTF!
My insurance adjuster tells me that the woman denied the event and her insurance company will not reimburse me for the damages. My options are:
1) Drop it and chalk it up as getting f'd in the A
2) Go to litigation, in which case I might recover 50% of the damages
What do you guys make of this? It just seems like I'm getting screwed here and theres got to be a better option. The damages are 800$, is it worth pursuingLast edited by F4iGuy; 04-27-2008 at 09:53 AM. Reason: spelling

i would persue it man..****in old bitch. at least give it a shot. theres to many geriatric old ****s putting peoples lives at risk for thier own convenience. that shit ****in enrages me. i watched an old man back into my car a couple months ago trying to park, then he doesnt even pull forward! the guy gets out and walks away with is car still pushing up against mine?!?! so when he finally walks back out i was like "uh, hey...i think you parked a little too close there eh? did you not notice hitting something?" and he smiles at me, says "nope" and gets in his ****in car! i was so ****in enraged, i gave his rear fender a huge boot and dented the shit out of it. lol. buddy just carried on driving, probably didnt even notice. im sorry, but when youre 70, you should have an annual road test to be able to drive.

Ok this is my personal experience,try to make it short to the point.My daughter's car gets hit by uninsured motorist,police report says it was the guys fault no doubt about it.WE took him to small claims court,the damages to her car was $5,000,it cost $400 to file.Time for trial came,guy never showed up,we got a judgement in our favor for $5,400.This was one year ago.To this day we haven't recovered 1 cent,and theres nothing we can do about it.So,whats it worth to you?

Why did you not follow her while on the phone with 911 letting them know that you are following a woman who ran you off the road and caused damage to your vehicle?

Tank, I completely agree with you. People need to get tested for their liscense at a certain age. I'm upset about the damages to my vehicle, but even more pissed that this woman is still driving her big old car on the road as she approaches 90 and cannot see. How would you feel having your daughter, son, wife, mother on the same road as this lady?
Inky, I think your post is going to influence my decision. My agent said, "There is a small possibility you might recover 50% of the damages if it goes to litigation" not to reassuring if you ask me. Don't you love insurance companies? 99.9% profit, no business like it.
Ninja, I seriously considered following, and did for a short period. Two reasons I did not:
1) It was Easter Sunday and I was late getting to my parents house, this woman was heading in the opposite direction
2) Seeing how recklessly this woman drove her car didn't have me wanting to pursue her, especially into north philly where she lives.

Bro, thats your fault. If you understand the law, there are many ways to get your money...with interest.
To the poster:
Yes! Go after her. Pay a lawyer $75 to send her a harsh letter. Most of the time a letter from a lawyer will put enough pressure on them to do whatever you want. Do you think she is going to pay a lawyer to fight back? Hell NO! Shes too cheap to tell the truth in the first place! You dont even have to be right, but if you know how to manipulate the law, you will always win. Educate yourself, bro. GL

i'd find where she lives and beat the $800 out of her...that story really pissed me off cus i just watched a movie about a hit and run called Reservation Road

well first of all it isn't considered hit and run unless she actually hit your car, and from what im seeing you hit the curb and are expecting her to pay for your accident... you may as well pay out of pocket and not even bother taking it to court cause you will lose... there is no police report, and her car never actually hit yours...

I just talked to a buddy in law school. His advice was "You should have let her hit your car then there'd be more evidence and a better outcome".

I was just gonna say.... unfortunately I was in a similar situation about two years ago. I avoided a head-on collision that was 100% the other driver's fault, and I ended up hitting a lightpole instead. I was issued the ticket and had to pay for my own damages.
The police told me (unofficially) that I should have let the guy hit me and then it would have been his fault, but since he didn't actually hit anything he wasn't considered involved in the accident.

IMO u should marrie the old bird so u get her fat ass life insurance when she dies and u buy urself a new car... Just my 2cc
