another reason why I spent the money and built my gym at my house
-
03-17-2011, 12:20 PM #7
well, that's really not the reason. the real reason is because I'm a lazy asss and don't want to drive to the gym.
well, that and I'm a cheep bastad and don't want to have to pay to go to the gym.

a good few of the local gyms have jumped on the news and are offering week long free trials to those affected by the closure so at least i wont miss any training while im looking for a suitable gym.

welcome mate
another thing... I've been to a gym several times, and it's hard for me to get in the zone when there are people standing around watching. for me, it's one of those kinda private things, like tossing one off....

I pay monthly as well. I am a member of a franchise so chances are it will not go away but still better to be safe. My fiance's father lost a yearly membership two months into a gym here in New Hampshire that also went belly up.

sue them you will win if you paid your full payment up front and they close there doors without notice its fraud
that why the owner of gold gym got sued by me and tons of others i renewed my contract 2 days before they closed there doors there own workers didnt even know they were closing
in florida any gym must give 30 days notice to all its members before closing there doors or its a breach of contract u should read your contract bro

yeah bro that sucks, like GB said gyms are shady. First one i ever joined i was 19 and i was told it was month to month so the ammount of months on the contract was blank, then when i said i wanted to cancel my membership, the asshole pulled out the contract that he'd wrote in 12 months on after i signed, thinking i threw my copy away, then when i refused to pay out the rest of the contract the guy took me to small claims court, I showed up he didn't, judge dismissed with prejudice

there's a difference between A corporation that would be say walmart then you have chains like papa johns pizza you can buy into the chain name and its a self run business
now that being said most gyms are self run gyms they buy into the name but they are not covered by the corporation this is something the lawyer will have to find out even still i made 6k off golds gym when i sued them

shitty deal... its too bad this isnt a big enough deal that it will be investigated. You can always find someone responsible who is inevitably the one who made the decision to accept payments knowing the gym was failing.

they were an independent gym and were recently taken over in nov '10 by an english group (i reckon fitness first or the like), there are or rather were three gyms based in dublin, the biggest around with indoor track etc.
my gfriend rang their headquarters in england to see about refunds and they claimed to know nothing about it!!! based on tht id reckon theres fvck all chance of a refund.
if the money is gone its gone, its the whole pain of getting somewhere else and different feeling equipment etc tht gets on my tits, things like wider grip widths, balances on dbells etc really play in my head, sounds strange i know but it interrupts my trainingLast edited by dec11; 03-17-2011 at 04:51 PM.

wrong. Sorry mate, but a business is allowed to conduct itself in it's normal course as it normally does up to the point it files a petition for bankruptcy and is given a case number at the clerks office. Once it gets a case number, things change. If they took your money before they filed, you are sunk.
How do I know? I was a BK rep for a couple of years for a major financial services company.
if a BK7 liquidation, you have a right to the liquidated assets in this order
Secured creditors have first claim on all liquid assets
Attorneys
Middle Men
Wages....
Way at the bottom is unsecured creditors (You)
which means you get nothing in all likelihood.

Some states like MD offer protection under the law ( Remember all those lifetime memberships sold in the 70s) and anyone accepting advance payment is required to place a bunch of money into a kitty so check out the laws in your area. Another thing is that the membership may transfer to the new owners as part of the purchase.

Its bad in Ireland when your gym closes, because even though there are probably other gym's in the area, most are not greatly equipped. Gym's are robbing gits anyway, been going to my local gym for near on 3-4years, im a student and no point having the year membership, so when i go on a weekend they still charge me €10.....like come on

well here in florida u cant get away with its fraud you cannot take in new contracts 30days before you close your doors our gym did there for it was breach of contract so we were first in line for suing him lol i sued for 10x my year membership fee
