Criminal Justice Act
There are so many offenders or I should
say the accused who try to plead the Insanity defence to stop them standing
trial but even though the law will still find a way around this plea it
really gets to me that these sick individuals who commit these serious
offences don't have the guts to stand trial and would rather seek a hospital
order which would result in a longer sentance. The unfittness to plead
is a cop out by splineless creeps.

Something else what fuks me off is the sentences what are given out to serious offences what are way to lenient. Some offences don't warrant freedom in my eyes yet some judges give out very short sentences.

It depends what the offence is of course but when they plea insanity and a hospital order is enforced they are detained in a secure hospital until the Home Secretary approves his release. This provision means that they would be detained for a longer period than the norm for let's say murderers. If they get acquitted on the grounds of insanity then he would be kept Longer away from the public than he would for a sentence for murder.

There are many elements to hospital orders, you can use the mental health 1983 or the criminal procedure insanity act or even the diminished responsibility so there isn't anything set in stone how each is detained, treated or released. It all depends on what offence and which act they get detained under.
I just get fuked off sometimes how some people will try everything to try and get away with a easier life and some hate taking the stand and will do anything to not stand trial. Should be locked up and punished daily for life.

There was a story in the paper today that blew my mind. A guy rear ended a 24 year old woman who was on a motorcycle with his car. He attempted to flee the scene by driving away. The woman and the bike were jammed under his car preventing him from leaving and forcing him to reverse. He then ran over her again. She died of her injuries. He received a charge of vehicular homicide and got 15 years. I don't see how the family can feel thats justice.

if he has good behavior he could be out in half the time. If they are overcrowded he might do 1/3 of sentence
