My dad told me a story about when he bounced in college at Tennessee. He worked in a bar where they had slapjacks and those little wooden baseball bats to use if needed, usually to hit a guy in the legs or something. Well the University of Tennessee wrestling team was there and a few started acting up. They tried to get the guys causing a scene to leave. One of the drunk ones got into it with a bouncer and after hitting the bouncer a few times and trying to take him to the ground, the bouncer hit him across the head with a little bat. He knocked him out and split him open bad. They arrest him for assault even though every one said it was in self defense.

A weapon used on an unarmed or in your case pretty much unarmed individual usually doesnt end well
There is a big difference. The person wasn't unarmed, he had a bottle (Not to mention, a broken bottle in his hand). I know someone that got attempted murder for trying to hit someone in the head with a beer bottle. It is very well considered a weapon and not to mention it was a broken beer bottle which is even worse. That person could easily been charged with an attempted murder charge for coming at someone like that. That would be like pulling a knife.

If it went down how he said it did, he should truly have no problems. Basically, he used a weapon in fear of his life. That is what I would say
