There is a big difference. The person wasn't unarmed, he had a bottle (Not to mention, a broken bottle in his hand). I know someone that got attempted murder for trying to hit someone in the head with a beer bottle. It is very well considered a weapon and not to mention it was a broken beer bottle which is even worse. That person could easily been charged with an attempted murder charge for coming at someone like that. That would be like pulling a knife.
If it went down how he said it did, he should truly have no problems. Basically, he used a weapon in fear of his life. That is what I would say
