Well I finally went to court on this matter and was found not guilty of DWI but I was found guilty of not taking the breath test. I got the some rap for not talking the breath test. It makes no cents. But I dont go to jail I just loss my drives L for a long time. Anyways I am appoling the case and the judge did not take my drivies L yet. Does anyone have excperenes in appeles court. IMy lywer told me its a whole new ball gome..

do you have a reative that lives in another state?? someone that you can have mail sent to.. preferable someone in texas or the south??

if you do, plan a trip there, use their address and get a new license.. before you lose this one..

most states do not have resiprosity (sp) (sharing access of information) so you may be able to sqeak by..

You could try this, but I believe a majority of states do now share this information. There are a few states that don't, so if you do some research and can get a licens from a state that does not share info, you may be able to sneak by.

Judge wont' take your license anyway. The DMV will put out a license pick up order on you and it will be taken by the police if you don't mail it in. You can try moving but technology is so good anymore that most states DMV correspond with one another. I don't know what your appealing if your found not guilty of DUI. The license issue is a DMV issue not court. If you want to appeal the breath test conviction, go for it. Tough to argue the fact that you didn't take it.

Do you happen to know anyone in city or state government??? If you do, it is all about how much money you can put in the pockets of the right people... You live in NJ dude, probably the most crooked state of all 50, if you know the right people and have enough money to grease them up you can get out of just about anything, or get anything done. So start thinking real hard about connections you have, and use them..... Thats my best advice to you to be honest, your not gonna win if you play fair...

yeah here in the state of texas its a law dont submit breath or blood they take your dl not sure how jersey works but dont thinks there is much of a way out of it. i know you wouldnt here anyway good luck but i would do some checking before you waste a bunch more money on a lawyer that cant help you.

Thats how it works in NJ as well. By not taking the breathalizer you are basically pleading guilty and automatically lose your license, even if you didn't have a sip of alcohol all night. I don't know why anyone would refuse.

you would refuse because then you are not guilty of driving while intoxicated..

you won't have to go to class, spend time in the work house, drive with "whiskey plates", house arrest with an ankle monitor...

yea, there are lots of reasons to not submit..
