Here's the answer to your question, a case I would think several on here would remember.

Yes, when law enforcement arrest someone they have to test the substance to see what it is. If it's a fake substance this does help the arrested individual; however, it doesn't save him by any means, as gixxer said intent is a big part of it. Remember Dave Palumbo's arrest a few years back? He went to prison and what for? Selling fake HGH. There was no illegal substance being sold, not at all....it was nothing but he still want to jail.

(In the US, at least) Selling fake drugs carries the same sentence as selling real drugs. If the buyer (or undercover cop) thought you were selling something illegal, it doesn't matter what you actually gave him.
