    Just because a person is swerving doesn't mean they are drunk at all. Could be talking on the phone, elderly, playing with the radio etc..... I have stopped people for only have one working headlight and arrested them for DUI. You NEVER know until you stop them is the point here. I can't just count on a swerving driver to be intoxicated. Would I pull them over, absolutely, is it going to be a drunk, don't know until I investigate further. Remember some people can handle their alcohol better than others. I have seen people who have a B.A.C. of .150 who act and do field sobriety better than people who are .06.
